A foreign worker from the UK will need the legal right to work in Canada, either as a temporary foreign worker or have Permanent residence or Citizenship status in Canada. A Canadian Resident or Citizen can start employment at any time.

Hiring a temporary Foreign Worker

Normally a work permit is required. Processing timelines will depend on type of work carried out in Canada but can usually be issued in weeks. A work permit is usually issued for a period of 1-3 years.

To apply for a work permit from outside Canada a potential employee requires:

  • A job offer from a Canadian employer
  • A completed work permit application
  • Written confirmation from Service Canada that the employer can hire a foreign worker to fill the job. This confirmation is called a positive labour market opinion (LMO).
  • In some cases, a Labour Market Opinion is not required. Details

Labour Market Opinion

A Positive LMO can be issued by Service Canada (formally HRSDC) as confirmation that the employer can hire the foreign worker(s) they require. The employer contacts Service Canada for the LMO.

Service Canada can issue a LMO after assessing the impact the foreign worker would have on Canada’s labour market. An employer may be required to advertise the position in question.

Once the employee has the required documentation for a work permit an application can be sent by the employee to CIC or a work permit obtained at a port of entry into Canada.

Benefit to an employer

A work permit issued to a foreign worker is normally specific to a particular position so working and living in Canada is usually dependent on the employee retaining their status and role within the company/ organisation. This gives the employer confidence in the medium/ long term retention of the employee.

What if I cannot get a LMO for the potential employee?

If a job offer to a potential employee is not applicable for a positive Labour Market Opinion, the employee can either:

1. Apply for Nomination through a provincial skilled worker stream

A foreign worker may also consider applying for residency, with a job offer, through a provincial Nomination Stream. A work permit may also be considered in these cases:

2. Apply for residency through the Federal Skilled Worker Stream

A job offer will expedite the potential Candidates application for residency through the Federal Skilled worker Stream
